The next Board of Directors meeting is scheduled for Wednesday, February 15, 2012 at 7:00 PM in the lobby. The agenda for the meeting can be found in the "Management" tab above four days in advance of the meeting. All residents are welcomed and encouraged to attend.

Dear Homeowner:
As you are aware, the Board of Directors has been in negotiations with the garage owner, Coast Prime Properties, regarding the parking rate. Unfortunately, a resolution to this dispute has not been reached. Coast Prime Properties notified Management today that they are demanding $213 per month for each parking space effective immediately. The Association will be paying this amount under protest while exploring legal remedies to determine a fair market rate for the parking spaces.
How this will affect you:
Effective March 1, 2012, your dues will increase per the assessment schedule on the reverse side of this notice.
If you have two or more bathrooms and lease a second space through the HOA:
The rate for these spaces has increased to $213 per month. If you would like to relinquish your space, please let Management know (email is best – eteves@actionlife.com) as soon as possible.
Since the February statements have already been mailed, one of the two below options will apply:
1. If you elect to keep your second space, you will have an additional $128 charge for February on your March statement and a $213 per month recurring charge going forward. Please keep in mind that you may decide to give up the space at any time in the future.
2. If you relinquish your second space by February 1, an $85 credit for the month of February will appear on your March statement and all future recurring charges will cease.
If you are leasing a parking space directly from Coast Prime Properties:
Management has not received any notice regarding a parking rate increase.
If you are set up with automatic payments through your bank, please be sure to update the amount accordingly. For those of you enrolled in ACH, no action is necessary.
The Board of Directors has been working diligently with both parking and legal experts to determine the best course of action for Eastern Columbia’s homeowners. Management will continue to keep you informed as things progress.
Your patience and understanding during this challenging time are greatly appreciated.

ATTENTION ALL HOMEOWNERS!!!
PLEASE join the Board of Directors on either Saturday, January 21 at 11am or Monday, January 23 at 7pm in the lobby to discuss the parking rent which is scheduled to increase on January 26.
Eastern Columbia’s attorneys, David Wankel and Denise Iger, will be in attendance to answer any questions and to review potential options for resident parking.

NOTICE TO MEMBERS
REGARDING EMERGENCY EXECUTIVE SESSION MEETINGS
As of January 1, 2012, California law requires that a homeowners association notify its members two days prior to the Board of Directors meeting in executive session, despite the fact that only Board members may attend executive session meetings. Executive session meetings are held solely to discuss sensitive matters including litigation, matters relating to the formation of contracts with third parties, member discipline, personnel matters, or a member's payment of assessments.
You have recently received correspondence indicating that the Board and the Association’s legal counsel are in negotiations with Coast in an attempt to avoid litigation regarding the Parking Agreement and the parking space rates. Because the negotiations require consideration by the Board, the Board must meet in executive session to discuss offers, strategy, attorney advice, etc.
Unfortunately, because of the time constraints involved in this particular matter, the executive session meetings must be called on an urgent basis. The law provides that prior notice of the executive session meetings need not be given if an emergency situation exists. An emergency situation exists if there are "circumstances that could not have been reasonably foreseen by the board, that require immediate attention and possible action by the board, and that, of necessity, make it impracticable to provide notice."
As a result, this notice is being posted in an attempt to comply with the law and inform the members that the Board anticipates meeting on an emergency basis many times over the next several weeks to discuss the Coast dispute in executive session. Again, the law does not permit non-Director members to attend executive session meetings. We simply wish to make you aware of the fact that the Board is working hard to resolve the dispute and will be unable to post prior notice of each executive session meeting because of the urgency involved in this matter.
